This Washington Consumer Health Data Privacy Policy (“Policy”) describes the practices of Alimetrix, Inc. d/b/a SimplyTest®, (“Company” or “We”) for collecting and using Washington residents’ Consumer Health Data.

“Consumer Health Data” means data that is linked or reasonably linkable to a specific individual, identifies that individual’s past, present, or future physical or mental health status, and is collected or controlled by Company.

This Policy applies only to Consumer Health Data that is not protected health information (PHI) as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Consumer Health Data collected and maintained by Company as a HIPAA covered entity is governed by our Notice of Privacy Practices.

This Policy applies to the SimplyTest® website (https://simplytest.solutions/) and portal (https://providerportal.simplytest.com/signin) (collectively, the “Website”). This Policy does not apply to any sites, products, applications, platforms, or other services not directly linking to this Policy.

Please read this Policy carefully to understand our policies and practices regarding your Consumer Health Data and how we will treat it. If you do not agree with our policies and practices, you should not use the sites, products, applications, platforms, or other services linking to this Policy.

Consumer Health Data We May Collect About You

We collect and use different types of Consumer Health Data from and about you, including:

  • Information about any of the following:
    • individual health conditions, treatment, diseases, or diagnoses;
    • diagnostic testing, treatment, or medication;
    • bodily functions, vital signs, symptoms, or measurements of physical or mental health status.
  • Data identifying a consumer seeking health care services. Health care services means any service provided to a person to assess, measure, improve, or learn about a person’s mental or physical health, including but not limited to:
    • individual health conditions, status, diseases, or diagnoses;
    • social, psychological, behavioral, and medical interventions;
    • health-related surgeries or procedures;
    • use or purchase of medication;
    • bodily functions, vital signs, symptoms, or measurements of the information described in this subsection; or
    • diagnoses or diagnostic testing, treatment, or medication.
  • Any inferences of the above categories derived, extrapolated, or inferred from non-health information.

We use these categories of Consumer Health Data for the following purposes:

  • Providing saliva-based health diagnostic testing services, including oral health and functional health testing, and delivering your test results to you, including through the portal.
  • Processing and fulfilling your test orders and related requests.
  • Processing payments and managing billing for your account.
  • Communicating with you about your test results, account, and our Website.
  • Facilitating services and operations performance, security, and integrity, including undertaking activities to prevent, detect, and investigate security incidents.
  • Identity verification and authorization, quality control, and portal optimization.
  • Recordkeeping and auditing.
  • Complying with our legal obligations, risk management, investigations, and other legal and compliance reasons.
  • Our internal research and service design and development.

Consumer Health Data Sources

We collect Consumer Health Data from the following sources:

  • You, including when you register an account on our Website, order or request diagnostic testing services, submit contact forms, or communicate with us.
  • Your healthcare provider, including your dentist or telehealth provider, who may order diagnostic testing on your behalf and provide us with information necessary to fulfill the test order.
  • Your device when you visit or interact with our Website, including through cookies and similar technologies that automatically send us information when you browse, use, visit, or otherwise interact with our Website. This includes browsing data, interaction data, IP addresses, and device identifiers collected by Google Analytics and Google Tag Manager and transmitted to Google, LLC.
  • Payment processors and other financial institutions.

Consumer Health Data Disclosures

We do not sell your Consumer Health Data.

We may disclose any of the Consumer Health Data categories listed above to the following:

Your ordering healthcare provider, such as your dentist or telehealth provider. When a healthcare provider orders a diagnostic test on your behalf, we share your test results and analysis with that provider so they can use the results in your care. In some cases, a dentist orders the test and receives the results directly; in other cases, you may order the test through a telehealth provider, and the results and analysis are shared with that telehealth provider.

Service providers, processors, and contractors that help us operate our Website and provide our services, including payment processors that assist with billing and payment collection through our Website and website technology providers, including CloudFlare, Inc. for website security and performance services and Google, LLC for website analytics services, which may involve the collection of browsing data and device identifiers when you visit our Website.

  • We instruct these affiliates, processors, service providers, and contractors to only use consumer health data as permitted by our contracts with them and consistent with applicable law.
  • We may also disclose consumer health data as permitted by applicable law, including:
  • With your consent.
  • To prevent, detect, protect from, or respond to security incidents, identity theft, fraud, harassment, or malicious or deceptive activities.
  • To a third party acquiring our assets if Company sells its business or otherwise is part of a merger, acquisition, bankruptcy, or other transaction involving a third party taking control of our assets or business.
  • To investigate, report, or take legal action to protect our rights, property, and safety and the rights, property, and safety of others.
  • To protect your or others’ vital interests, including health and safety.

Your Privacy Rights

You have specific rights with respect to your Consumer Health Data. You have the right to:

  • Request confirmation that we collect, share, or sell your Consumer Health Data.
  • Request access to your Consumer Health Data that we have collected or control, including:
    • a list of all third parties and affiliates that we have shared or sold your Consumer Health Data to; and
    • the email addresses or other online method to contact those third parties and affiliates.
  • Withdraw your consent for our collection and sharing of your Consumer Health Data.
  • Request that we delete your Consumer Health Data.

To exercise any of your rights set out above under Washington consumer health privacy law, or to withdraw your consent at any time, please contact us using the information below. We collect and share your Consumer Health Data only to the extent necessary to provide the diagnostic testing services and related products you request. If we collect or share your Consumer Health Data for any purpose beyond providing these services, we will first obtain your consent for such collection and, separately, your consent for such sharing, as required by Washington law.

Response Timeline. We will respond to your request without undue delay and within forty-five (45) days of receipt. If reasonably necessary, we may extend this period by an additional forty-five (45) days and will inform you of the extension and the reason within the initial period.

Appeal Process. If we refuse to take action on your request, you may appeal our decision by contacting us using the information below. We will respond to your appeal in writing within forty-five (45) days, including an explanation of the reasons for our decision. If your appeal is denied, we will provide you with a method to contact the Washington Attorney General to submit a complaint.

We will not unlawfully discriminate against you for exercising any of your rights under Washington’s My Health My Data Act. We will not deny you goods or services, charge you different prices or rates, or provide you a different level or quality of goods or services because you exercise your consumer health data rights.

Consumer Health Data Retention

We retain your Consumer Health Data only for as long as reasonably necessary to fulfill the purposes described in this Policy and to comply with applicable legal and regulatory requirements, including medical records retention and laboratory regulations. When Consumer Health Data is no longer needed, we securely delete or de-identify it.
